Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and the operators of Scout ("Scout," "we," "us," or "our") governing your access to and use of the Scout mobile application and related services (the "Service").

By downloading, accessing, or using Scout, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. Educational Tool - Not Medical Advice

SCOUT IS AN EDUCATIONAL TOOL ONLY. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Scout is designed to help you identify possible mammal-derived ingredients based on information you provide and product/label data available to the App. Ingredient lists, manufacturing processes, and formulations can change without notice, and OCR/scanning technology is not error-free. Scout's flags, "likely safe" indications, and swap suggestions are estimates only and may be inaccurate or incomplete.

You must always independently verify ingredients on product packaging and with manufacturers or restaurant staff before consuming or using any product, and you should consult a qualified healthcare provider regarding Alpha-gal Syndrome, your personal sensitivity, your diet, and any suspected allergic reaction. Never disregard professional medical advice or delay seeking emergency care because of something you saw in the App.

If you are experiencing a medical emergency or believe you are having an allergic reaction, call your local emergency number (e.g., 911 in the U.S.) or seek emergency medical care immediately. Do not rely on Scout in an emergency.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account and use Scout. If you are under 18, you represent that you have your parent or guardian's permission to use the Service. Scout is not directed to children under 13, and we do not knowingly permit children under 13 to create accounts.

3. Accounts

To access certain features, you must create an account using an email/password or a supported social sign-in option (Google or Apple). You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at the email below if you suspect unauthorized use of your account.

4. Subscriptions & Payment

Scout offers a free tier as well as optional paid subscription plans that unlock additional features. Subscriptions are billed and processed entirely through the Apple App Store or Google Play, and are subject to their respective terms:

• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
• Your payment method will be charged for renewal through your Apple ID or Google Play account within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time through your Apple ID account settings or Google Play subscription settings. Deleting the App does not cancel your subscription.
• Refunds are handled by Apple or Google in accordance with their respective refund policies; we do not directly process payments or issue refunds.
• Prices may change; we will provide notice of any price change as required by the applicable app store and/or law before it applies to you.

5. Your Content

You may input information into Scout, such as your sensitivity profile, reaction logs, and notes ("Your Content"). You retain ownership of Your Content. You grant us a limited, worldwide, non-exclusive license to host, store, and process Your Content solely as necessary to operate and improve the Service. You are solely responsible for the accuracy of Your Content.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Reverse-engineer, decompile, or attempt to extract the source code of the App, except where permitted by law
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to the Service, other accounts, or related systems
• Use automated means (bots, scrapers) to access the Service without our prior written consent
• Upload or transmit content that is unlawful, infringing, or harmful to others
• Misrepresent your identity or impersonate any person or entity

7. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the Scout name and marks, is owned by us or our licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to download and use the App on devices you own or control, for your personal, non-commercial use.

8. Third-Party Services

The App relies on third-party service providers (for example, cloud-based OCR/image recognition, analytics, and crash reporting, as described in our Privacy Policy) to deliver certain features. We are not responsible for the availability, accuracy, or performance of third-party services, and your use of any third-party service or website linked from the App is at your own risk and may be subject to that third party's own terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE APP'S INGREDIENT DETECTION, OCR SCANNING, MENU ANALYSIS, OR SWAP SUGGESTIONS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE, OR THAT ANY PRODUCT FLAGGED AS "LIKELY SAFE" WILL IN FACT BE SAFE FOR YOU.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH, OR PERSONAL INJURY, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY ALLERGIC REACTION OR ADVERSE HEALTH EVENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $50 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Scout and its officers, employees, and service providers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, Your Content, or your violation of these Terms.

12. Termination

You may stop using the Service and delete your account at any time through the App's settings. We may suspend or terminate your access to the Service if we believe you have violated these Terms, or for any other reason, with or without notice. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles, except where prohibited by local law. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in North Carolina, and you consent to personal jurisdiction there, unless applicable law in your jurisdiction requires otherwise.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and us only, not with Apple, and Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the App infringes third-party intellectual property rights. You agree to comply with any applicable third-party terms when using the App. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

15. Google Play Additional Terms

If you downloaded the App from Google Play, you acknowledge that your use of the App must also comply with Google Play's then-current Terms of Service.

16. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means and update the "Effective Date" above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
